Are You Getting the Breaks You Deserve?

You Deserve a Break…Literally

According to Tennessee Labor Law, employees have a right to take a 30-minute break for every 6 consecutive hours that they work. In most scenarios, it is a violation of Tennessee law for an employee to fail to give their employees ample breaks. If you are an employee in the state of Tennessee and your employer declines to give you a 30-minute unpaid break when you work a shift of 6 consecutive hours or more, you may have a claim against your employer.

Exceptions to the Rule

If your line of work allows you to take regular breaks, your employer may not be obligated by law to allow you to take a designated break. Employers also have to have a minimum amount of employees to be bound by the law that gives employees the right to a break. My employer is not giving me my breaks at work, what should I do?

  • First, it would probably be best to try to talk to your employer about taking breaks in accordance with the law. This method is most likely to give you results the fastest. Your employer may have overlooked the situation and may alleviate the problem.
  • If your employer is not responsive to your request, you may be able to pursue further action. Before proceeding, you should likely consult with a labor and employment law attorney.
