Tennessee Workers’ Compensation Law 101

 In Workers' Compensation Law

For many people who get an injury while on the job, workers compensation benefits are a lifeline that helps them cover their expenses and get the healthcare they need. If you are employed in Tennessee and suffer an injury on the job during your employment there, there’s a good chance that you’re eligible for workers compensation.

Tennessee Workers’ Compensation Law

Most businesses that have five people or more are required to purchase workers’ compensation insurance. The insurance will help the employee take the time they need to get well. The employee receives specific benefits in the event of an on-the-job injury.

If you plan to file a workers’ compensation claim, you need to know some of the basics of the laws. After all, you are the injured person, but the person who files the claim is working for your employer. Report claims as soon as they happen, using the correct forms. If you’re unsure about any part of the process, contact a Tennessee workers’ compensation attorney.

What the Law Says About Claims

  • If you are hurt while working, the first thing to do is get medical help and inform your employer.
  • You only have 30 days to notify your employer. If you’re injured and hoping you get better, you could miss out on this deadline. Once 30 days pass, you can’t get benefits.
  • Employers must submit your claim to the Department of Labor and Workforce Development’s Workers’ Compensation Division within one business day of receiving it.
  • Employers must also inform their workers’ compensation insurance company as soon as possible.

Once all of the things above are complete, your employer’s insurance company has to contact you within two working days. In Tennessee, they have a total of 15 days to let you know about their decision.

Benefits Under Workers’ Compensation

People who receive workers’ compensation in Tennessee get some benefits, but they don’t last forever. You will probably get full medical coverage for treatment of your injury as well as reimbursement for lost wages lost due to disability. Injured workers have other rights as well.
